The rules for using likecmtshare. Please read them before creating an account.

About these terms

These terms are a contract between you and the business that runs likecmtshare:

  • Legal name: DALTRO INFOTECH LLP, a limited liability partnership registered in India (LLPIN ADB-9890)
  • Address: New Delhi, India

"We", "us" and "our" mean that LLP. "You" means the person or business using likecmtshare.

By creating an account, connecting an Instagram account or using likecmtshare, you agree to these terms, our privacy policy, our refund and cancellation policy and our cookie policy. If you do not agree, please do not use the service.

Eligibility

  • You must be at least 18 and able to enter a binding contract under the Indian Contract Act, 1872
  • If you use likecmtshare for a business, you confirm you are authorised to accept these terms on its behalf
  • You must own, or be authorised to manage, every Instagram Professional (Business or Creator) account you connect, and keep it in good standing with Meta

The service

likecmtshare is software that lets you automatically reply to comments and story replies, send DMs, apply follow gates, collect leads and send files or links in response to interactions on Instagram accounts you connect through Meta's official APIs.

Every account starts on a free plan. The features and limits of each plan, including how many DMs you can send, are shown on our pricing page. We may add, change or remove features over time, including when Meta changes its APIs or policies.

Our role

likecmtshare is a tool. You decide which posts to automate, what your messages say, which links and files they include and what you do with your leads. We do not choose who receives your messages and we do not edit your content.

To the extent the Information Technology Act, 2000 applies to us as an intermediary, we follow its due-diligence requirements, including acting on lawful orders and running the grievance process described below.

Your account and Instagram connection

  • Keep your login details private. You are responsible for everything done through your account
  • We never ask for your Instagram password. We connect only through Meta's official login and access tokens
  • You can remove our access at any time from your Instagram settings. Your automations will stop working when you do
  • Tell us straight away at support@likecmtshare.com if you think someone has accessed your account without permission

Agencies and teams

Agencies, social media managers and freelancers may use likecmtshare to manage clients' Instagram accounts, as long as they:

  • Have each client's written permission to manage their account and data
  • Make sure each client's use follows these terms and Meta's rules
  • Remain responsible to us for every account they connect

Your responsibilities

You are responsible for every message, file and link your automations send. You must:

  • Follow Meta's Platform Terms, the Instagram Terms of Use, Community Guidelines and messaging policies, including only messaging people who interacted with your account first
  • Follow all laws that apply to you, including privacy, consumer protection and advertising laws
  • Have a lawful basis to collect your followers' details, and tell them how you will use them
  • Use lead details only for the purpose people shared them for
  • Stop messaging people and delete their details when they ask you to

Acceptable use

You must not use likecmtshare to:

  • Send spam or unsolicited messages, or message people who have not interacted with you
  • Send content that is unlawful, defamatory, obscene, pornographic, harassing, hateful, or harmful to children
  • Mislead people about who you are or where a message comes from, or send phishing, scams or false information
  • Share content you do not have the rights to, or infringe anyone's intellectual property
  • Send malware or harmful code
  • Threaten the unity, integrity, security or sovereignty of India, public order or friendly relations with other countries
  • Collect passwords, card or bank details, government ID numbers or health information from people
  • Bypass Meta's rate limits or rules, or scrape Instagram
  • Copy, reverse engineer, overload or interfere with likecmtshare, or access it other than through our app
  • Resell or white-label likecmtshare without our written permission

This list follows Rule 3 of the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

Protecting minors

Instagram allows people from age 13, so your automations may reach people under 18. You must not use likecmtshare to send them age-inappropriate content or promote adult products, alcohol, tobacco, gambling or other restricted goods to them. You are responsible for the content your automations send to minors.

Plans, billing and taxes

  • Prices are in Indian rupees (INR) and exclude GST, which is added at the applicable rate
  • If you are GST-registered, add your GSTIN before paying to receive a GST invoice for input tax credit
  • Paid plans are billed in advance for the period you choose (for example monthly or yearly) and renew automatically until you cancel
  • Payments are processed by RBI-authorised payment partners, whose terms also apply. For automatic renewals you will receive a pre-debit notification as RBI rules require
  • We will tell you at least 14 days before a price change. New prices apply from your next renewal
  • If a renewal payment fails, we may move your account to the free plan or pause paid features until payment is made

Cancellation and refunds

  • You can cancel anytime from your account settings. Cancelling stops the next renewal and you keep paid features until the end of the period you have paid for
  • All payments, renewals and credit top-ups are non-refundable, including for unused time or credits, except where applicable law requires a refund
  • If you are charged twice, or money is deducted for a failed payment, we will return the extra amount in full. This is a billing correction, not a refund
  • If you have a billing problem, please contact support@likecmtshare.com before raising a dispute or chargeback with your bank. We may suspend accounts with unauthorised or fraudulent chargebacks

Your content and data

You own your content: your messages, templates, links, files and the leads you collect. You give us a non-exclusive, royalty-free licence to host, store, copy, transmit and process that content only as needed to provide, secure and support the service. The licence ends when the content is deleted.

You can export your leads at any time. We may use aggregated, de-identified data that does not identify you or anyone else to run and improve the service.

If you send us feedback or ideas, we may use them without any obligation to you.

Our intellectual property

The likecmtshare name, logo, website, software, designs and documentation belong to us and are protected by the Copyright Act, 1957, trademark law and other laws.

While your account is active and you follow these terms, we give you a limited, non-exclusive, non-transferable, revocable licence to use likecmtshare for your own business or personal Instagram accounts, or for your clients' accounts as described in agencies and teams.

Suspension and termination

You can close your account at any time from your account settings. Export your leads first. We delete your data within 30 days of closure, as described in our privacy policy.

We may suspend or limit your account, with notice where reasonable, if:

  • You break these terms, the law or Meta's policies
  • You send spam or engage in abusive, fraudulent or unlawful activity
  • Meta asks us to, or flags your account for policy violations
  • Your account puts the service, other users or us at security, legal or operational risk
  • A payment is overdue

For a serious breach that can be fixed, we will give you written notice and 15 days to fix it before we close your account. We may close it straight away if the breach cannot be fixed, or if the law or Meta requires it. Unless the law or Meta prevents it, you will have 15 days after closure to export your leads.

Sections that by their nature should continue after termination, such as payment obligations, disclaimers, limitation of liability, indemnity and dispute resolution, still apply.

Instagram and Meta

likecmtshare relies on Meta's APIs and policies, which Meta can change at any time. Automated messaging carries risks such as rate limits, temporary messaging blocks or restrictions that Meta may apply to your account. We are not responsible for actions Meta takes on your account or for changes to its platform that affect our features.

likecmtshare is an independent product. It is not affiliated with, endorsed by or sponsored by Meta Platforms, Inc. or Instagram. "Instagram" and "Meta" are trademarks of their owners. See our Meta compliance page.

Disclaimers

likecmtshare is provided "as is" and "as available". To the extent the law allows, we do not give warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee uninterrupted or error-free service, instant message delivery, or results such as reach, leads, sales or follower growth.

Limitation of liability

To the extent the law allows:

  • We are not liable for indirect, incidental, special, consequential or punitive losses, including lost profits, revenue, data or goodwill, or restrictions Meta places on your Instagram account
  • Our total liability for all claims relating to likecmtshare is limited to the fees you paid us in the 3 months before the event that gave rise to the claim

Nothing in these terms limits liability for fraud, or any liability or consumer right that cannot be limited under Indian law, including the Consumer Protection Act, 2019.

Indemnity

You agree to compensate us, our partners and staff for third-party claims, legal notices, fines, penalties and reasonable legal costs that arise from:

  • Your breach of these terms or of applicable law, including the IT Act, 2000 and the DPDP Act, 2023
  • The messages, files and links sent through your account
  • A complaint by a person or authority that you messaged someone without permission, sent spam or misused their data
  • Your breach of Meta's terms or policies, or of anyone's rights

Governing law and disputes

  • These terms are governed by the laws of India
  • If you have a dispute with us, please first email support@likecmtshare.com. We will try to resolve it within 30 days
  • If it is not resolved, it will be settled by arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by mutual agreement. The seat and venue of arbitration is New Delhi and proceedings will be in English
  • Subject to arbitration, the courts at New Delhi have exclusive jurisdiction
  • This does not take away any right you have to approach a consumer commission under the Consumer Protection Act, 2019

General

  • Entire agreement: these terms and the policies they link to are the whole agreement between us about likecmtshare
  • Severability: if any part is found unenforceable, it will be modified as little as needed and the rest stays in force
  • No waiver: if we do not enforce a term straight away, we can still enforce it later
  • Assignment: you may not transfer these terms without our written consent. We may transfer them as part of a merger, acquisition or restructuring
  • Force majeure: neither of us is responsible for delays or failures caused by events beyond reasonable control, such as natural disasters, epidemics, war, power or internet outages, Meta outages or API changes, or changes in law
  • Notices: we will send notices to your account email or show them in the app. Send notices to us at support@likecmtshare.com. For legal notices, put "Legal notice" in the subject line

Grievance officer

In line with the IT Act, 2000 and the IT Rules, 2021, you can contact our Grievance Officer about these terms, content sent through likecmtshare, or legal notices:

We acknowledge complaints within 24 hours and resolve them within 15 days of receipt, or sooner where the law sets a shorter timeline. Please include your name, your Instagram username or account email, and enough detail for us to look into the issue.

Changes to these terms

We may update these terms. For material changes we will tell you by email or in the app before they take effect. Changes needed to follow the law or Meta's policies may apply sooner. If you do not agree with a change, you can cancel before it takes effect. If you keep using likecmtshare after that, the updated terms apply.
